I'll probably screw this up but I'm attempting to post a poll that will help clarify who's able to get dns from NPS and who isn't.

If NPS is not "in concert" with Dish, then they should be attempting to qualify anyone and based on accepted prediction models such as L-R. It should have nothing to do with if Dish offers locals in that person's DMA. Yet they seem to be rejecting those that had / have Dish LiLs on their account.

I would think if they have any chance of getting this past the courts, they'd have to establish they can (and do) provide this service more independently of Dish.

On-line showed I was eligible for all the nets even though I have a Grade B CBS feed(which I could only get with a 100' or higher tower). When the nets were activated I did not have the CBS feed so I'm assuming they are looking at these requests individually and carefully.
 
What really irks me is the charade that's being played here.

If NPS would tell people the real reason they won't qualify someone, it would simplify things considerably but because they are (I believe)treading in such murky waters with their "arrangement" with Dish, they apparently can't be up-front.

IMO if the procedure for obtaining DNS from NPS stays the way it is, there is no way it will avoid legal scrutiny.

They and Dish have to know this, so either we will soon be seeing changes in the NPS deal or this is nothing more than an last ditch attempt to hopefully stall customers from defecting long enough for congress to come up with something.

How is the court going to look at this if you need a Dish receiver AND a some active with a Dish subscription in order to get NPS - rather than a) using a Dish receiver without an active Dish subscription or b) a NPS receiver.

I agree. It seems obvious to me that NPS is "in concert" with Dish if only Dish customers are eligible.
 
It would be completly legal if they did NOT ask for your phone number. The fact that they are asking for your number and know who you are if they do have your number means that they have the info from E*. The If they asked for your service address then if you qualified based on your address only then they should take your name and E* receiver info as any independent company would need to start provideing a new customer service. Many people have reported they NPS already has thier recvr info in the sytem. This stinks. E* took a great idea and f**ked it up. What elses is new!
