So you mean to tell me if I try to activate a 721 they will send out an owned 522 in it's place? Why didn't they offer me an owned 522 to being with? Seems a bit rediculous to me. I didn't want to get stuck with a 522. I wanted to get some of the money back I had in the 721. When you own a receiver you at least have flexibility.

No, they will send out a leased 522 in its place, but they will waive the usual DVR fee on the 522.
The monthly bill is exactly the same with the leased 522 as with the 721.

However, the exclusion of 192K units could only be applied to units already in place at the time of the 2006 verdict. Newer placements could not be excluded.

I wonder how they reassigned the 192K units since then. They retired all 3 of the mentioned models (721, 921, 942)

The 192K can't be reassigned. Dish has already been shot down trying to reassign and fill out the number. They acquiesced.

TiVo has conceded that, conceptually, EchoStar is entitled to exchange previously-placed same-model-number units with Unenjoined Units (those subject to the 192,708-unit exemption provided for in the Injunction) in need of repair. The parties only disagree as to the specifics of such a program. For example, TiVo argues that this right exists only with respect to units placed before the jury verdict; a proposition that EchoStar rejects. The Injunction issued several months after the jury verdict and makes no mention of that date with respect to the phrase "placed with an end user or subscriber."

In any event, due to internal business decisions, EchoStar recently determined that it no longer needs the relief requested. EchoStar is increasingly moving to set-top boxes compatible with MPEG-4 technology, as opposed to MPEG-2, which is the platform for the DP-721, DP-921, and DP-942 models.

Thus, EchoStar has recently adopted a new program in which it replaces non-functioning boxes of those three models with different models compatible with MPEG-4 technology.

WHEREFORE, EchoStar respectfully moves the Court for withdrawal of their Motion for Interpretation of the Permanent Injunction filed on June 13, 2008 (Docket No. 831).

Not that there is an "official" plan, but I'm sure there is an internal plan to get to only MPEG-4 systems.

MPEG4-only will have nothing to do with this lawsuit, MPEG2 or MPEG4 has nothing to do with the lawsuit, the DVR functionalities do. DISH's goal is to prevent the injunction from taking place, and win on appeal. This is the only way at this point to ensure their DVRs will stay on. If all things fail, DISH will likely just pay TiVo to keep the DVRs on.

Those 942s, 721s just happened to be the old obsolete models they picked to discontinue.

I'm certain there are many reasons for shutting down the 721. Mainly that the user base doesn't justify maintaining that line of code.

The TiVo suit may factor in, but I don't think it's the principle reason.

and i agree if that was the case they would shut down all older dvrs , but its gonna come a time u wont be able use mpeg 2 recivers some one posted like 3yrs on this site ill guess they are proplly right i just wish dish came up with better plan for coustmers owning these recivers instead of bascaly screwing them fornaly i got lucky and got 3 out of my 5 replaced with out leasing from them at almost no cost i stll stuck with 2

Nope. Anything you've read that claims that is speculation.

If you read the documents, you'll see that ~190k receivers were exempted. Read the press release a few posts back. TiVo agreed that exempted receivers could be replaced with like units, but Dish dropped the issue.

They could have stayed in service, at least until they broke, but with the encryption change Dish decided this was a good time to drop support for those.
